Supreme Court agrees to hear a case that could determine whether Facebook, Twitter and other social media companies can censor their users

  • The Supreme Court has agreed to hear a case that could determine whether users can challenge social media companies on free speech grounds.
  • The case, Manhattan Community Access Corp. v. Halleck, No. 17-702, centers on whether a private operator of a public access television network is considered a state actor which can be sued for First Amendment violations.
  • The case could have broader implications for social media and other media outlets. In particular, a broad ruling from the high court could open the country's largest technology companies up to First Amendment lawsuits.

Commenting on the article you sent, “Americans Strongly Dislike PC Culture:”

I think the numbers on the Conservative/Trump base at 25% of the electorate is about right. As is the number for the hard left. But this study strongly smacks of a group of academics with a theory that they used a survey to prove.

Despite its flaws, I do think this survey reveals a cause for great concern to the GOP. With up to 50% of the electorate tired of political correctness but also imbued with shared social values, that include moderate to very moderate views on the social issues that matter the most to the hard left and hard right. That’s a huge swing vote. Much bigger than traditional analysis suggests. This is born out by issue based attitude research, which strongly suggests that a majority of Americans no longer oppose a total ban on abortion or gay marriage; who refute racism; and who support equal rights for women for example.

Those swing voters are not going to feel comfortable with a further move to the right and/or support a President who only ever plays to the 25% of hardcore Conservatives. Any more then they would support a swing to the hard left.

Israel’s secret assassinations (book review)

Prosecutors at the International Criminal Court might want to consider this book Exhibit A if Israeli government and military officials are ever indicted for war crimes. It contains open admissions of guilt in plotting and executing extralegal assassinations in violation of international law.

It was not just assassinations. Bergman writes, “‘state security’ was used to justify a large number of actions and operations that, in the visible world, would have been subject to criminal prosecution and long prison terms: constant surveillance of citizens because of their ethnic or political affiliations; interrogation methods that included prolonged detention without judicial sanction, and torture; perjury in the courts and concealment of the truth from counsel and judges.”

UPDATE 10: GOP lost the House and that is probably for the best — the NeverTrumpers from the GOP are the ones that were flushed out. Control of the Senate increased and that assures a flood of conservative Justices.

MID-TERM SPECIAL: Trump Triumphs — Senate, Justices, Never-Trumpers Gone from House — Deep State Done!

I continue to recommend that the President commit to #UNRIG Election Reform Act, with the goal of having one third of Congress in 2020 be from a small party or independent.

Worth a Look: The Day Amazon Murdered History and Banned Books with Capricious Abandon

Phi Beta Iota: Amazon is indeed banning many books (as well as reviews and entire reviewer channels), not only on the Holocaust but on Sandy Hook and other US Government atrocities, but it's more  complicated than that.  To make the point, note that this book is sold by Amazon.

By Germar Rudolf – Amazon is the world’s biggest book retailer. It rakes in some 50% of all consumer spending on books in the U.S. and dominates several foreign markets as well. Pursuant to the 1998 declaration of Amazon’s founder Jeff Bezos to offer “the good, the bad and the ugly,” customers once could buy every book that was in print and was legal to sell.

That changed on March 6, 2017, when Amazon banned more than 100 books with dissenting viewpoints on the Holocaust, after having been pressured by Jewish lobby groups for years to do so.
